The publication in 1957 of the Wolfenden Report occasioned a celebrated controversy in which profound theoretical issues concerning the relation between law and morality, and the legal enforcement of morality were discussed. The principal disputants were Lord Justice Devlin and Professor H. L. A. Hart. It is by now well known that the main recommendation of the Wolfenden Report was the reform of the criminal law so that homosexual behaviour in private between consenting male adults should no longer be a (...) criminal offence. As homosexual behaviour in Christendom was at the outset punishable in the ecclesiastical courts, and subsequently, with the demise of the ecclesiastical courts, in the secular courts, the Wolfenden recommendation on homosexuality marked a major departure from the prevailing state of affairs in which the precepts of Christian morality, especially relating to sexual morals, were at first enforced by the ecclesiastical courts, and then by the secular courts. In this article I propose to discuss some recent theological contributions to the problem of the historicity of the Gospels, and I wish to suggest that philosophical issues may ultimately be relevant to its solution.

Kant's readers have disagreed about whether, according to his account of cognition, concepts, representations of the understanding, are involved in intuitions, representations of sensibility. But proponents of the affirmative 'conceptualist' answer and those of the negative 'non-conceptualist' answer have alike presupposed that such involvement should be construed in a particular way: i.e., as the involvement of particular concepts in particular exercises of sensibility. I argue, on the contrary, that it should not be: that though, for Kant, no concepts are applied (...) in exercises of sensibility, nonetheless the understanding, the faculty of concepts, is teleologically internal to sensibility and, therefore, to its exercises. That is, those exercises are per se directed towards the provision to the understanding of objects to which its fundamental concepts, the categories, are applicable, though no act of categorical application is internal to them. This conception of sensibility, available only in light of a careful distinction between capacities and acts, is demanded, I argue, by Kant's conception of a priori knowledge as elaborated in his Transcendental Deduction. T. A. Cavanaugh's Hippocrates' Oath and Asclepius' Snake: The Birth of the Medical Profession articulates the Oath as establishing the medical profession's unique internal medical ethic - in its most basic and least controvertible form, this ethic mandates that physicians help and not harm the sick. Relying on Greek myth, drama, and medical experience (e.g., homeopathy), the book shows how this medical ethic arose from reflection on the most vexing medical-ethical problem -- injury caused by a physician -- and argues (...) that deliberate iatrogenic harm, especially the harm of a doctor choosing to kill (physician assisted suicide, euthanasia, abortion, and involvement in capital punishment), amounts to an abandonment of medicine as an exclusively therapeutic profession. The book argues that medicine as a profession necessarily involves stating before others what one stands for: the good one seeks and the bad one seeks to avoid on behalf of the sick, and rejects the view that medicine is purely a technique lacking its own unique internal ethic. It concludes noting that medical promising (as found in the White Coat Ceremony through which U. S. medical students matriculate) implicates medical autonomy which in turn merits respect, including honoring professional conscientious objections. (shrink)

WHO suggests mental ill health in terms of depression to be the highest ranking disease problem in the developed world in 2020–2030 and claims a public health approach to be the most appropriate response. But some argue that the alarming reports on mental ill health have their ground in the methods of inquiry themselves and refer to medicalization as an important issue. The aim of this article is to explore and illuminate the issue of what is meant by mental health (...) and mental ill health and what it means that mental ill health is a major public health problem. Basically, two understandings and aspects of public health exist: a ‘reductionist’ and a ‘holistic’ with connections to different theories of health. These diverging understandings may lead to quite different public health responses, and they may have different consequences with regard to medicalization. It is concluded that we need more clearly elaborated ways to think about public health so that the increased attention to mental ill health as a public health problem does not in itself lead to medicalization in terms of just medical treatment. Otherwise, we risk losing the importance of public health as an overarching social and political instrument. (shrink)

Kant claims in the religion that morality leads ineluctably and inevitably to religion. I argue that a moral agent can resist the movement towards religion and still remain moral. My strategy differs from many found in the literature insofar as I do not believe we need to attack the notion of the highest good. I argue instead that the promotion of the highest good can be a moral duty for a rational nonbeliever.

This book gives a general survey of political thought from Homer to the beginning of the Christian era. To the evidence of the philosophers is added that of Herodotus, Euripides, Thucydides, Polybius and others whose writings illustrate the course of Greek political thinking in the Classical and Hellenistic periods. This re-issues the second, updated edition of 1967.

Professional identity and competent ethical behaviors of nursing students are commonly developed through curricular inclusion of professional nursing values education. Despite the enactment of this approach, nursing students continue to express difficulty in managing ethical conflicts encountered in their practice. This descriptive correlational study explores the relationships between professional nursing values, self-esteem, and ethical decision making among senior baccalaureate nursing students. A convenience sample of 47 senior nursing students from the United States were surveyed for their level of internalized professional (...) nursing values (Revised Professional Nursing Values Scale), level of self-esteem (Rosenberg’s Self-Esteem Scale), and perceived level of confidence in ethical decision making. A significant positive relationship (p < 0.05) was found between nursing students’ professional nursing values and levels of self-esteem. The results of this study can be useful to nursing educators whose efforts are focused on promoting professional identity development and competent ethical behaviors of future nurses. (shrink)

T. A. Cavanaugh defends double-effect reasoning (DER), also known as the principle of double effect. DER plays a role in anti-consequentialist ethics (such as deontology), in hard cases in which one cannot realize a good without also causing a foreseen, but not intended, bad effect (for example, killing non-combatants when bombing a military target). This study is the first book-length account of the history and issues surrounding this controversial approach to hard cases. It will be indispensable in theoretical ethics, applied (...) ethics (especially medical and military), and moral theology. It will also interest legal and public policy scholars. (shrink)

The discussion on the phenomenology of life will continue to be crucial to the general outlook and direction of phenomenological investigations. The imp- tance of it is not only the fact that it is an innovation in the philosophical circle, but it is also an effort that contributes to the re-reading of the hitherto ex- gerated differences between phenomenology and metaphysics. What is new and signi?cant about life is that even though it is evident in the?ow of the history of (...) philosophy, no philosopher has seriously addressed it. Not many philosophers have said something in particular about life in serious philoso- ical re?ection. The discussion on life by Henri Bergson attests to this and one 3 can hardly point to other deep re?ections elsewhere about the subject. The advantage here about our area is not only that it has extended the horizon of phenomenological thinking, it has also helped to lead phenomenology from the constitutive analysis to a creative impetus that has brought a new point of view to the?eld, hence raising questions about the general philosophical t- dition from ancient times. This is a reading which my philosophy attempts to investigate about Tymienieckan thought. The emphasis in philosophy till now has been more on reason in its int- lection and pure rational dimension based on the earliest conception of the human person distinguished by rationality. Since 1973 the practice of infanticide for some severely handicapped newborns has been receiving more open discussion and defence in the literature on medical ethics. A recent and important argument for the permissibility of infanticide relies crucially on a particular concept of personhood that excludes the theological. This paper attempts to show that the dispute between the proponents of infanticide and their religious opponents cannot be resolved because one side's perspective on the infant is shaped by a metaphysics that is (...) emphatically rejected by the other. In such a situation philosophical argument is powerless to bring about a resolution because there can be no refutation of one side by the other. (shrink)

The editors' extensive introduction offers an in-depth analysis that places the work within the broader framework of Safavid intellectual and social history.

In early major works, Cassirer and Schlick differently recast traditional doctrines of the concept and of the relation of concept to intuitive content along the lines of recent epistemological discussions within the exact sciences. In this, they attempted to refashion epistemology by incorporating as its basic principle the notion of functional coordination, the theoretical sciences' own methodological tool for dispensing with the imprecise and unreliable guide of intuitive evidence. Examining their respective reconstructions of the theory of knowledge provides an axis (...) of comparison along which to locate Cassirer's Neo-Kantianism and Schlick's pre-positivist empiricism, and an immediate background of contrast to the subsequent rise of logical empiricism. For in the absence of intuition all our knowledge is without objects and therefore remains entirely empty.
